Q: I want to hire a live-in nanny and want to pay her a set salary because I might only need her twenty hours one week, and fifty hours the following week. Is that OK?

A: In short, no. It is illegal to bank a nanny's hours. You must establish a set salary or number of hours guaranteed per week, even just to pique a candidate's interest and keep them committed! We would suggest guaranteeing a minimum of 30hrs guaranteed per week, where they are paid regardless if you use them or not. Oftentimes, you will find things for them to do to make up that time! My next question would be, what is your annual gross salary range? Will you offer overtime if they are working over 40 hours a week (or for over 45 hours/week for live-in candidates per some states' tax laws)? These are all things to consider before even posting an ad for your ideal nanny!
